1. Purchase and Exchange Policy

1.1 The Website provides you with an opportunity to browse various products that have been listed for sale through the Website (the “Product”) and to purchase the Product through the Website and have it delivered. In using the Services to purchase the Product through the Website, you will agree to the payment of the purchase price listed on the Website for the Product (the “Purchase Price”).

1.2 In order to purchase the Product, you must register as a User.

1.3 You agree and acknowledge that PayPal Australia Pty Limited (ABN 93 111 195 389) (“PayPal”) will be used to facilitate the purchase of the Product.

1.4 The Depot and Co may, at their sole discretion, agree to exchange or provide and equivalent store credit (the “Exchange Policy”) for any Product(s) purchased through the Services, so long as the following terms are met:

(a) you contact The Depot and Co by sending an email to shop@thedepotandco.com.au within forty eight (48) hours of your receipt of the Products explaining why you wish to exchange the Product(s);

(b) If The Depot and Co agrees to the exchange, it will provide you with a unique returns authorisation code to be used in all future correspondence between the parties;

(c) within ten (10) days of The Depot and Co agreeing to the exchange, you will return the Product(s) and the receipt of purchase to The Depot and Co at PO Box 831 Narrabeen NSW 201, ensuring that the packaging and labels still attached to the Product(s); and

(d) where The Depot and Co elects to provide an exchange, the Depot and Co will send a replacement product to your return address.

1.5 You acknowledge and agree that all postage costs associated with complying with clause 5.4 of these Terms are to be borne by you.

1.6 The following Products provided through the Services are not applicable pursuant to the Exchange Policy:

(a) sale items;

(b) custom orders;

(c) lighting;

(d) candles;

(e) body products; and/or

(f) jewellery.

2. Gift Cards

2.1 The Depot and Co offers gift cards for purchase through the Website (the “Gift Cards”).

2.2 The Gift Cards contain a unique code that can be used in the place of regular payment of the Purchase Price when purchasing Products from the Website and remain effective for a period of six (6) months from date of issue.

2.3 For the avoidance of doubt, purchases made using Gift Cards are subject to the same terms and conditions as normal purchases pursuant to these Terms.

3. Delivery

3.1 You acknowledge that the Services offered by The Depot and Co integrate delivery through the use of third party delivery companies (the “Delivery Services”) which may include but are not limited to the following companies:

(a) Australia Postal Corporation t/as Australia Post (ABN 28 864 970 579); and/or

(b) Temando Pty Ltd (ACN 120 582 738).

(the “Delivery Service Providers”)

3.2 You acknowledge that The Depot and Co does not provide the Delivery Services to you and you agree that The Depot and Co will not be liable to you for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Delivery Services.

3.3 In providing the Services, The Depot and Co may provide you with a variety of delivery and insurance options offered as part of the Delivery Services by the Delivery Service Providers. You acknowledge and agree that The Depot and Co is not the provider of these delivery and insurance options and merely facilitates your interaction with the Delivery Service Providers in respect to same.

3.4 In the event that an item is lost or damaged in the course of the Delivery Services, The Depot and Co asks that you:

(a) contact the Delivery Service Provider directly to request a refund or to claim on any insurance options available; and

(b) contact us by sending an email to shop@thedepotandco.com.au outlining in what way the Products were damaged in transit so we are able to determine if the Delivery Service Provider should be removed from the Services.

3.5 In the event that the item being lost or damaged in transit has not been resolved pursuant to clause 7.4 of these Terms, please contact us at shop@thedepotandco.com.au, providing suitable photographic evidence so that you can request an Exchange pursuant to clause 5.4 of these Terms.
